1. Site Conditions of Use

1.1 Introduction

1.2 Your Agreement to Terms and Conditions

By accessing and using the Site, including placing orders for products, you agree to be bound by these terms and conditions. If you are under 18 years of age, you must obtain your parent or guardian's consent before using the Site.

1.3 Registration and Use of Your Account

a. You must complete the customer registration process before placing an order.

b. You may not have more than one active account per email address. Your account is non-transferable. You may update, edit, or terminate your account at any time through the Site.

c. You are solely responsible for keeping your LoginID and password secure. You must notify us immediately if you suspect unauthorised use of your account by contacting our Customer Service team on 08 9358 3288 during business hours.

d. You must ensure all account information is accurate and updated promptly.

e. You are responsible for any costs associated with internet access to use the Site.

1.4 Your Obligations

You must:

a. Notify us immediately of any unauthorised access to your account
b. Provide your date of birth for purchase of restricted products (alcohol, tobacco)
c. Check product labels before consumption
d. Not use the Site for illegal activities or to breach third-party rights
e. Not engage in fraudulent or harassing behaviour
f. Not attempt to tamper with, reverse engineer, or hack the Site
g. Not use automated tools to scrape or retrieve Site content
h. Comply with all applicable Australian laws

You must not:

  • Use the Site for unlawful purposes or to infringe third-party rights

  • Post offensive, defamatory, or threatening material

  • Attempt fraudulent purchases

  • Use another person's details without permission

  • Transmit viruses or malicious code

1.5 Warranties

You warrant that:

a. All information you provide to us is true, accurate, complete, and up to date
b. The person receiving products at the delivery address is authorised by you
c. You comply with all relevant Australian laws regarding your use of the Site

1.6 Account Suspension and Site Availability

a. We reserve the right to refuse service, terminate accounts, or remove content if we reasonably believe you have breached these terms or used the Site fraudulently.

b. We may immediately suspend your account if:

  • The breach cannot be remedied, OR

  • You fail to remedy a breach within 10 days of our notice, OR

  • There is an emergency

c. We may stop offering the Site without prior notice. If we do, accepted orders will not be affected unless products become unavailable, in which case we will notify you and process refunds.

d. If we suspend or terminate your account, we will refund any account credits you are entitled to receive by direct deposit to your nominated account.

The Site may contain links to external websites not operated by us. We make no representations about these websites and are not responsible for their content. You access external websites at your own risk.

1.8 Accuracy of Information

We use best endeavours to ensure product descriptions and information are accurate, but we do not warrant that all information on the Site is error-free or current. Please check product details carefully.

1.9 Safety and Refusal of Orders

We are committed to the safety of our staff and delivery drivers. We may refuse, cancel, or restrict delivery of orders where we reasonably suspect:

Customer Conduct Issues:

  • Verbal abuse of our staff or delivery drivers

  • Physical assault or threatening behaviour

  • Damage to our vehicles

  • Fraudulent or criminal behaviour

  • Being issued a banning notice from any store

Safety Hazards:

  • Unsecured pets on the property

  • Inaccessible or dangerous environment (steep driveways, unsafe conditions)

We will use best endeavours to notify you of any refusal or cancellation.


2. Ordering and Purchasing Products

2.1 Ordering Products

a. You may order products by selecting items and submitting your order through the Site.

b. Your order is an offer to purchase products at the price shown at the time of ordering, including all delivery fees, service fees, and taxes.

c. We will confirm acceptance of your order by email. Each accepted order constitutes a binding contract between you and us.

d. You agree to provide current, complete, and accurate information when placing orders.

2.2 Minimum Order Amounts

The following minimum order amounts apply:

  • Delivery Orders: $50.00 (excluding delivery fee, service fee, and bag fee)

  • Click & Collect Orders: $40.00 (excluding service fee and bag fee)

These minimums are subject to change and we will notify you via the Site.

2.3 Restricted Products

Alcohol and Liquor

a. Age Verification: You warrant that you are 18 years or older and are not obtaining alcohol on behalf of anyone under 18 years.

b. Acceptance: Our sale of liquor is made at our licensed premises. Your offer to purchase is subject to:

  • Acceptance by the holder of the liquor licence

  • Compliance with applicable laws

  • Age verification and ID checks

  • Stock availability

c. ID Requirements: We reserve the right to check your ID at point of delivery. You must be present to accept delivery of orders containing alcohol.

d. Restrictions: You may not purchase alcohol for resale to third parties or for trade purposes.

Tobacco and Age-Restricted Products

a. If you are under 18 years old, you may not order tobacco products, sharp objects (knives, blades, etc.), or other age-restricted items.

b. You warrant that you are not obtaining tobacco products on behalf of anyone under 18 years.

c. We reserve the right to refuse or cancel orders where we have concerns about the quantity of restricted items ordered.

2.4 Fees and Charges

You agree to pay the following for accepted orders:

a. The purchase price of each product
b. Bag Fee: Flat fee for providing bags (pick-up or bagged delivery only) - subject to change
c. Delivery Fee: As quoted at checkout for delivery orders
d. Service Fee: As quoted at checkout for click & collect orders
e. Cancellation Fee: Up to $20 if order cancelled on day of delivery/collection (plus perishable charges)
f. Unavailable Delivery Fee: Up to $25 if unable to deliver due to access issues or no one home
g. GST where applicable

All prices displayed on the Site include GST.

2.5 Price Information

a. Product prices are shown at the time you place your order and may differ from in-store prices.

b. We reserve the right to amend delivery and service fees at any time.

c. Prices may vary by delivery postcode.

d. If a product you ordered is out of stock or unavailable:

  • If we pre-authorised payment, we deduct unavailable items from your final charge

  • If we charged you at checkout, we refund the value of unavailable items within 3-5 business days

  • Delivery fees are not refunded for partial order unavailability

2.6 Payment Methods

a. You must pay online using one of our accepted payment methods:

  • Visa and Visa Debit

  • MasterCard and MasterCard Debit

  • PayPal

  • NP Supermarket Gift Cards

  • Other methods displayed on the Site

b. You authorise us to pre-authorise and/or debit the payment amount from your nominated card.

c. If payment fails for an accepted order, we may cancel your order and notify you.

d. You must not use fraudulent or unlawful payment methods.

2.7 Invoices and Receipts

a. We will provide receipts at the time of delivery or collection showing:

  • Total fees and charges

  • Out-of-stock items

  • Refunds for unavailable items

b. If payment was taken upfront, your receipt will show any refunds processed.

2.8 Fraud Prevention

We have processes to detect potentially illegal or fraudulent transactions. We may contact you by phone or email to confirm your payment details. If we cannot confirm details, we may cancel your order.


3. Product Delivery and Collection

3.1 Acceptance or Rejection of Orders

a. We reserve the right to accept or reject any order for any reason, including if products are unavailable or there is a pricing error.

b. Each accepted order creates a binding agreement for supply of those products in accordance with these terms.

c. If we reject an order, we will notify you as soon as possible. Any payments processed will be refunded.

3.2 Product Purchase Limits

a. Unless otherwise stated, you may purchase up to 36 units of any single product per order. Lower limits may apply for certain products or locations, which we will display on the Site.

b. You may not purchase products for resale to third parties or for trade purposes.

c. If we have concerns about order quantities, we may contact you to discuss or reject the order.

d. If you want to place orders exceeding our standard limits, contact our Customer Service team on 08 9358 3288 at least 7 days in advance.

3.3 Delivery Service

a. We only deliver to locations where we provide delivery services, as shown on the Site.

b. Delivery Timeframes: Timeframes provided at checkout are indicative only. Delays may occur due to traffic or unforeseen circumstances. We do not provide refunds or discounts for late deliveries.

c. Delivery Options:

  • Standard delivery with signature

  • Contactless delivery (photo confirmation)

  • Leave unattended at specified location

d. Contactless Delivery: We will deliver to your door, photograph the delivery for confirmation, and knock to notify you. You must be present to be notified.

e. Restricted Products: You must be home to receive deliveries containing alcohol, tobacco, or other restricted items. Photographic ID may be required.

f. Identity Verification: The person accepting delivery must provide proof of identity (photographic ID). We may also request to verify the payment card. We will record ID details for restricted product deliveries.

3.4 Delivery Issues - Non-Attendance or Inaccessibility

If any of the following occur, we will not deliver your order:

a. No one or no appropriate person (e.g., 18+ years for restricted items) is home
b. We cannot access the delivery address
c. There is no suitable spot for unattended delivery

Fees: We may charge up to $25 plus perishable product charges before delivery is reattempted.

Your responsibility: You warrant that any person receiving your order is authorised by you and is of legal age for any restricted products.

3.5 Click & Collect Service

a. You may select our participating store for collection. Bring photo ID when collecting.

b. Collection Options:

  • In bags (provided by us)

  • BYO bags (where available) - you unpack from trolley into your own bags

c. Collection Window: You must collect within your booked time window.

d. Identity Requirements:

  • Photographic ID is mandatory

  • Signature required

  • Payment card may be requested for verification

  • If collecting via locker, you'll receive a collection code

e. Restricted Products: You must ensure the person collecting is 18+ years old with valid ID.

f. Fees for Non-Collection:

  • Up to $25 fee if you don't collect within the time window

  • Perishable product charges may apply

  • A new service fee applies for rescheduled collection

3.6 Risk and Title

a. Risk (responsibility for loss/damage) passes to you:

  • On delivery to your address (including unattended), OR

  • On collection from our store

b. Title (ownership) passes to you on the later of:

  • Payment for the products, AND

  • Delivery/collection of the products

3.7 Bulk Orders

a. Orders exceeding 250kg or consisting of abnormally high quantities are classified as Bulk Orders and incur handling charges:

b. We will contact you after you place a Bulk Order to advise the handling charge. You must confirm acceptance before the order is fulfilled.

c. To arrange bulk orders, contact us at 08 9358 3288 at least 7 days in advance so we can ensure stock is available.


4. Order Cancellation and Amendment

4.1 Cancellation by You

a. Before Day of Delivery/Collection: You may cancel through the Site up to 30 minutes after you placed the order. No fees apply.

b. Refunds: If we charged you at checkout, we refund the full amount (including delivery/service fees) minus any cancellation fees to your original payment method within 3-5 business days.

4.2 Cancellation by Us

We may cancel your order without liability if:

a. Requested products are unavailable
b. There is a pricing or product description error
c. You have breached these terms and conditions
d. Safety concerns exist at the delivery address

If we cancel due to unavailability or error, we will notify you and issue a full refund including delivery fees. If we cancel due to your breach, we may charge cancellation and perishable fees for same-day cancellations.


5. Product Substitution and Unavailable Items

5.1 Substitution Policy

a. We reserve the right not to provide a substitute and instead issue a refund.

b. We cannot provide substitutes for certain items (tobacco, baby formula) and will refund instead.

5.2 Missing Items

a. Check your receipt to see if items are marked as out of stock. If so, a refund is automatic.

b. For missing items not marked as out of stock, contact us within 24 hours of delivery/collection via email at npsupermarketoffice@gmail.com

c. Once we verify the item was not delivered, we will refund the product price to your payment method.


6. General Terms

6.1 Consumer Guarantees

a. Our goods and services come with guarantees under the Australian Consumer Law that cannot be excluded.

b. For major failures, you are entitled to:

  • Cancel your service contract

  • Receive a refund for unused portion or compensation for reduced value

  • Choose a refund or replacement for faulty goods

c. For non-major failures, we will remedy the failure in reasonable time. If not remedied, you are entitled to a refund.

6.2 Our Liability Limitations

a. We are not liable for external websites linked on our Site.

b. Our liability is limited to the cost of re-supplying or repairing goods.

c. We are not liable for indirect or consequential loss (loss of profits, data loss, etc.) unless caused by our gross negligence or wilful misconduct.

d. Our liability for loss or damage you cause or contribute to is reduced proportionally.

6.3 Intellectual Property

a. All Site content, design, text, and graphics are owned or licensed to us. You may not copy, adapt, or reproduce them without our written consent.

b. You may print the Site content for personal use only—not for commercial purposes.

c. You must not use our company name or trademarks without our written consent.

6.4 Changes to Terms and Conditions

a. We may change these terms at any time. Changes are effective when posted to the Site.

b. If changes materially and detrimentally affect you, we will provide reasonable notice.

c. Changes apply to future orders. The terms current when you placed your order apply to that order.

d. We recommend reviewing these terms each time you order.

6.5 Jurisdiction

a. These terms are governed by the laws of Western Australia, Australia.

b. Both parties submit to the non-exclusive jurisdiction of the courts of that place.

c. Your consumer law rights under the Australian Consumer Law are independent of these terms.

6.6 Privacy and Marketing Communications

a. By creating an account, you acknowledge our Privacy Policy, Collection Notice, and Cookies Statement.

b. You agree to receive marketing emails and SMS messages from us unless you opt out.

c. You can unsubscribe from marketing using the unsubscribe link in any email or by replying STOP to SMS messages.

d. Opting out of marketing does not stop us sending you important account or legal information.

e. We may use your information to personalise your experience and target ads on our Site and other websites. You can change your privacy settings to limit this.

6.7 Mobile App

a. By using our mobile app, you agree to these terms and conditions plus the app-specific terms below.

b. Safety: Do not use the app while driving. Comply with all road rules.

c. Store Finder: Trading hours shown are correct at publication. Check in-store for current hours.

d. App Usage: We may collect technical data about your device to provide updates and support.

6.8 Business Customers

If you use our Site as a business or on behalf of a business:

a. You and your authorised representatives agree to comply with these terms.

b. You warrant that all information provided is accurate and you comply with all relevant laws.

c. Any authorised representative under 18 years of age cannot order restricted products.

d. You enter these terms as agent on behalf of your authorised representatives.
